Terms and Conditions

§ 1 Scope and Provider

(1) These General Terms and Conditions (hereinafter "Terms") apply to all business relationships between RADEJOKO GmbH, Im Feldgarten 11, D-56379 Scheidt (hereinafter "Provider" or "we") and our customers (hereinafter "Customer" or "you") for the purchase of crystals and related services via our website www.celestia.art or other distribution channels.

(2) Consumer within the meaning of these Terms is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor independent professional activity. Entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.

(3) Deviating, conflicting or supplementary General Terms and Conditions will not become part of the contract, even if known, unless their validity is expressly agreed to in writing.

§ 2 Contract Formation

(1) The presentation of crystals on our website with the stated prices constitutes a legally binding offer.

(2) The customer can place an order by completing and submitting the order form. By submitting the order, the customer makes a binding offer to purchase the selected goods.

(3) The contract is concluded through our acceptance of the order, which occurs through an order confirmation via email or through delivery of the goods.

(4) Since our crystals are natural products and unique pieces, deviations in shape, color, structure and weight are possible and do not constitute a defect. The product images serve for illustration and may differ from the actual product.

§ 3 Prices and Payment Terms

(1) The prices displayed on the website at the time of ordering apply. All prices are in Euro and include statutory VAT.

(2) Shipping within Germany is free and included in the purchase price. For international deliveries, we will create an individual quote with the corresponding shipping costs.

(3) Payment is possible by:

• Bank transfer with advance payment (shipping after receipt of payment)
• Purchase on account by prior arrangement
• Cash payment on personal collection by arrangement
• Instant bank transfer on personal collection by arrangement

§ 4 Delivery and Shipping

(1) Delivery is made to the delivery address specified by the customer.

(2) The delivery time is individually agreed and depends on the availability of the respective crystal as well as the selected shipping method.

(3) Due to the high value and sensitivity of our crystals, shipping is exclusively:

• As insured package
• In special protective packaging
• With shipment tracking
• By courier service (collected directly from us and delivered to you)

(4) Shipping within Germany is free. For international deliveries as well as courier service, costs are calculated individually and communicated before contract conclusion.

(5) For self-collection by arrangement, shipping costs are waived.

§ 5 Warranty and Liability

(1) Statutory warranty rights apply.

(2) Since our crystals are natural products, natural characteristics such as:

• Inclusions
• Growth structures
• Color variations
• Small natural irregularities

are not defects, but an expression of the authenticity and uniqueness of the product.

(3) The customer is asked to immediately check delivered goods for completeness and obvious defects and to notify us of these as well as transport damage immediately.

(4) In case of justified complaints, we have the right to subsequent performance. If subsequent performance fails, the customer has the right to reduce the purchase price or withdraw from the contract.

(5) Customer claims for damages are excluded, unless one of the following cases applies:

• Intent or gross negligence
• Injury to life, body or health
• Violation of essential contractual obligations
• Liability under the Product Liability Act

§ 6 Right of Withdrawal for Consumers

(1) Consumers have a statutory right of withdrawal. Please refer to our withdrawal instructions for details.

(2) The right of withdrawal expires prematurely for contracts for the delivery of goods that are manufactured according to customer specifications or are clearly tailored to personal needs.

§ 7 Data Protection

(1) We process personal data of our customers only within the framework of applicable data protection regulations.

§ 8 Special Notes on Crystals

(1) Our crystals are natural products that have grown over millions of years. Each crystal is unique.

(2) We make no healing promises. Any effects of crystals on well-being are not scientifically proven.

(3) The proper installation and care of the crystals is the responsibility of the customer. We assume no liability for damage due to improper handling.

§ 9 Dispute Resolution

(1) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

(2) We are not willing or obliged to participate in dispute resolution procedures before a consumer arbitration board.

§ 10 Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If the customer is a merchant, legal entity under public law or special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is our business location in Scheidt.

(3) Should individual provisions of these Terms be invalid or unenforceable, the validity of the remaining provisions remains unaffected.

(4) Changes or additions to these Terms require written form. This also applies to the cancellation of this written form clause.
